Families with an international element
Which courts can hear the case?
Within the European Union, jurisdiction in divorce and parental responsibility matters is governed by Regulation (EU) 2019/1111. The habitual residence of the spouses or of the child is often decisive.
Which law applies to the divorce?
In many cases the law applicable to divorce and legal separation is determined by Regulation (EU) No 1259/2010 (Rome III), which allows spouses to choose the applicable law within certain limits.
Cross-border child abduction
If a child has been taken or kept abroad without the consent of the other parent, the 1980 Hague Convention and Regulation 2019/1111 provide for the prompt return of the child. Time is of the essence.
Recognition of foreign judgments
A divorce or custody judgment issued in another country may need to be recognised in Spain before it takes effect here. We can advise on the procedure.
Frequently asked questions
Do I need to live in Spain to get divorced here?
Not necessarily. Jurisdiction depends on factors such as where the spouses live or last lived together and their nationality, under the applicable European or Spanish rules. We review your situation to confirm whether the Spanish courts can hear the case.
Can a divorce be handled by a notary in Spain?
Yes. An uncontested divorce can be formalised before a notary when there are no minor children, or adult children with support measures attributed to the parents, and both spouses are assisted by a lawyer.
How long does a divorce take in Spain?
It depends on whether it is uncontested or contested and on the workload of the court. An uncontested divorce with a signed agreement is much faster than a contested one.
Which court handles a family case in Toledo?
It depends on the last family home and on the residence of the parties and the children, under the Spanish rules of procedure. We confirm this for each case.
